We investigated the contributions of familiarity of setting, self-relevance and self-projection in time to episodic future thinking. The role of familiarity of setting was assessed, in Experiment 1, by comparing episodic future thoughts to autobiographical future events supposed to occur in unfamiliar settings. The role of self-relevance was assessed, in Experiment 2, by comparing episodic future thoughts to future events involving familiar others. The role of self-projection in time was assessed, in both Experiments, by comparing episodic future thoughts to autobiographical (...) events that were not temporal in nature. Results indicated that episodic future thoughts were more clearly represented than autobiographical future events occurring in unfamiliar setting and future events involving familiar others. Our results also revealed that episodic future thoughts were indistinguishable from autobiographical atemporal events with respect to both subjective and objective detail ratings. These results suggest that future and atemporal events are mentally represented in a similar way. (shrink)

Lack of understanding about the relationship between federal and state educational institutions brings confusion into discussions of democracy, equity and equality in schools. The 'right to education' continues to be espoused by American society as a birthright, yet it does not figure in federal documentation. This matter has repeatedly come to the attention of legislative courts, who have insisted that the question of education as a fundamental right be addressed. Numerous court cases have attempted to bring closure on this issue, (...) on the basis of such abstractions as national rights, equal access, opportunity and economic disparity among the petitions. However, legal judgments remain inconclusive, reiterating that education remains a state legislative issue. This paper explores the implications of a fundamental right to education through an examination of federal and state legal litigation, discussing the philosophical and ideological roots of discussion of rights and democratic values, and evaluating how federal and judicial participation contributes to overall misunderstanding regarding public schooling. Using a recent result of Busch and Gudder, we reconsider a theorem of Ludwig which allows one to identify a class of effect automorphisms as the symmetry transformations in quantum mechanics.

This paper discusses, within the context of analytical theory, some of the implications when rape is subsumed within the international crime of genocide and concludes that this type of enquiry is essential for creating a clearer framework to address and understand this violation. From the analysis undertaken, two critical questions become apparent: a) Does compatibility exist when rape is subsumed within the category of a group violation (genocide), if rape is constructed as a violation of an individual’s sexual autonomy? i (...) b) Is the link between rape and genocide necessarily problematic within this notion of autonomy for the individual victim of rape? The process unfolds within an analytical theoretical approach that touches upon the current concept of human rights with its focus on the individual. Although the key element is the individual, the concept of human rights also creates a space, albeit limited and at times controversial, for the group. As such, this paper identifies some of the theoretical implications that emerge once rape is subsumed within the international crime of genocide, which is defined as a violation committed against particular groups. The evolution of civilization has, in fact, been marked by a clean break located at the era when man discovered the rudiments of agriculture and animal husbandry and began to produce his own food. Whereas for the three million years during which he had to provide for his needs exclusively through hunting, fishing (...) and gathering, his progress was extremely slow, the adoption of a new way of life based on agriculture and animal husbandry allowed man to transform himself in less than twelve thousand years from deer hunter into astronaut. The rise of the idea of the Anthropocene is promoting multiple reflections on its meaning. As we consider entering this new geological epoch, we realize the pervasiveness of humankind’s deconstruction and reconstruction of the Earth, in both geophysical and discursive terms. As the body of the Earth is marked and reshaped, so is its idea. From a hostile territory to be subjugated and exploited through sovereign commands, the Earth is now reframed as a vulnerable domain in need of protection. The (...) mode of sovereignty, which has accompanied human and legal history and practice during modernity and its project of mastery, is no longer useful. Humanity’s control of the Earth is being reimagined and reconfigured along biopolitical coordinates of thought and action. Biopolitics shifts the focus of power, changes its modalities of interventions, and rearticulates its legitimacy on the idea of taking responsibility for the Earth, for nature. A biopolitical re-orientation of law captures the fundamental aim of caring for nature, of fostering its vital possibilities and of enhancing its productive potential. Yet, biopolitics engulfs nature in its entirety under its framework of control, where protection and subjugation, vulnerability and productivity, life and death are constantly entangled in a reciprocal and inevitable relation of indistinguishability. Sovereignty becomes thus a key modality of biopolitical intervention, when nature is recalcitrant, wild, spontaneous, unpredictable, violent, dangerous. Biopolitics, thus, remains caught in an undecidable dilemma, where in order to protect the Earth, it must subjugate it; to save it, it must condemn it. In this respect, biopolitics remains utterly modern, or as argued by Roberto Esposito, modernity has always been biopolitical, insofar as modernity has emerged as a framework for the protection of life against life’s own excesses. But how can we escape the biopolitical reframing and enframing of the Earth and its total subsumption under its matrix of control? How can we rethink the encounter between law and nature without remaining entangled in the aporetic dilemma of biopolitics? An aesthetics of wonder may offer a way. (shrink)

It now seems technically feasible to culture human embryos beyond the “fourteen‐day limit,” which has the potential to increase scientific understanding of human development and perhaps improve infertility treatments. The fourteen‐day limit was adopted as a compromise but subsequently has been considered an ethical line. Does it remain relevant in light of technological advances permitting embryo maturation beyond it? Should it be changed and, if so, how and why? What justifications would be necessary to expand the limit, particularly given that (...) doing so would violate some people's moral commitments regarding human embryos? Robust stakeholder engagement preceded adoption of the fourteen‐day limit and should arguably be part of efforts to reassess it. Such engagement could also consider the need for enhanced oversight of human embryo research. In the meantime, developing and implementing reliable oversight systems should help foster high‐quality research and public confidence in it. (shrink)

One of the principal reasons for the confusion in which recent technological developments, and developments in the physical, chemical and biological sciences generally, have plunged us, consists in our inability to harmonise our means and our ends, to subordinate the former to the latter, to verify constantly their appropriateness or their incompatibility, and to evaluate their overall relation to man's final ends.

Subjects enrolled in studies testing high risk interventions for incurable or progressive brain diseases may be vulnerable to deficiencies in informed consent, such as the therapeutic misconception. However, the definition and measurement of the therapeutic misconception is a subject of continuing debate. Our qualitative pilot study of persons enrolled in a phase I trial of gene transfer for Parkinson disease suggests potential avenues for both measuring and preventing the therapeutic misconception. Building on earlier literature on the topic, we developed and (...) tested an interview guide that focuses on how the subjects decided to participate, emphasizing the integration of subjects’ various statements that are relevant to assessing the therapeutic misconception, rather than evaluating them as isolated statements. The results indicate that a subject’s understanding of the purpose of research is best explored in juxtaposition to the subject’s motivation for participating. (shrink)

Donors to biobanks are typically asked to give blanket consent, allowing their donation to be used in any research authorized by the biobank. This type of consent ignores the evidence that some donors have moral, religious, or cultural concerns about the future uses of their donations – concerns we call “non-welfare interests”. The nature of non-welfare interests and their effect on willingness to donate to a biobank is not well understood. In order to better undersand the influence of non-welfare interests, (...) we surveyed a national sample of the US population using a probability-based internet panel. Logistic regression models assessed the demographic and attitudinal characteristics associated with participants’ willingness to give consent for unspecified future uses of their donation when presented with 7 research scenarios that raised possible non-welfare interest concerns. Most people had non-welfare interests that significantly affect their willingness to donate to a biobank using blanket consent. Some non-welfare interests are associated with subgroups but others are not. A positive attitude toward biomedical research in general was associated with increased willingness to donate, while concerns about privacy and being African American were associated with decreased willingness. Non-welfare interests matter and can diminish willingness to donate to a biobank. Our data suggest that trust in research promotes willingness to donate. Ignoring non-welfare interests could erode this trust. Donors’ non-welfare interests could be accommodated through greater transparency and easier access to information about the uses of donations. _Contributions to Law, Philosophy and Ecology: Exploring Re-Embodiments_ is a preliminary contribution to the establishment of re-embodiments as a theoretical strand within legal and ecological theory and philosophy. Re-embodiments are all those contemporary practices and processes that exceed the epistemic horizon of modernity. As such, they offer a plurality of alternative modes of theory and practice that seek to counteract the ecocidal tendencies of the Anthropocene. The collection is comprised of eleven contributions approaching re-embodiments from a multiplicity of fields, including (...) legal theory, eco-philosophy, eco-feminism and anthropology. The contributions are organized in three parts, ‘Beyond Modernity, ‘The Sacred Dimension’ and ‘The Legal Dimension’. The collection is opened by a comprehensive introduction that situates re-embodiments in theoretical context. Whilst closely bound with embodiment and new materialist theory, this book_ _contributes a unique voice that echoes diverse political processes contemporaneous to our times. I am, by profession, a “literary scholar”, in contrast to “scientists”. More precisely, I am a specialist in ancient Greek literature. Yet, in an age such as ours in which so often there is discussion of the standing of the various academic disciplines, of the differences implied by their methods and their needs, and of the means for making them work together, it seems to me more and more that very serious confusion is tending to becloud some essential definitions: that (...) of the study of literature in general, but even prior to that, the very definition of literature itself. It is very important to reach some understanding if we hope to avoid losing the richness of research and the very vitality of culture in the broadest sense of the term. (shrink)

Designer Biology: The Ethics of Intensively Engineering Biological and Ecological Systems consists of thirteen chapters that address the ethical issues raised by technological intervention and design across a broad range of biological and ecological systems. Among the technologies addressed are geoengineering, human enhancement, sex selection, genetic modification, and synthetic biology.

The concept of judicial objectivity is a cornerstone of modern legal systems. This article discusses the interplay between the lexical uses of the concept of judicial objectivity in cases that review the judicial impartiality of the court. The data for this project is retrieved from a large sample of cases from Hungary, Italy, Lithuania, Slovakia, Slovenia, Spain and the UK. The analysis of the data shows that in the case of alleged judicial bias, the concept of objectivity is referred to (...) in order to justify a series of judicial activities. In particular, the study provides a strong indication of what Legrand called ‘pre-judices’, which are the cultural aspects that are embedded in the process of the professional socialisation of each legal system. Quality of language comprehension determines performance in all kinds of activities including academics. Processing of words initially develops as auditory, and gradually extends to visual as children learn to read. School failure is highly related to listening and reading comprehension problems. In this study we analyzed sex-differences in comprehension of texts in Spanish in three modalities presented to 12–14-years old students, native in Spanish. We controlled relevant cognitive variables such as attention, phonological and semantic fluency and speed of processing. Girls’ (...) comprehension was similar in the three modalities of presentation, however boys were importantly benefited by dual-modality as compared to boys exposed only to visual or auditory text presentation. With respect to the relation of text comprehension and school performance, students with low grades in Spanish showed low auditory comprehension. Interestingly, visual and dual modalities preserved comprehension levels in these low skilled students. Our results suggest that the use of visual-text support during auditory language presentation could be beneficial for low school performance students, especially boys, and encourage future research to evaluate the implementation in classes of the rapidly developing technology of simultaneous speech transcription, that could be, in addition, beneficial to non-native students, especially those recently incorporated into school or newly arrived in a country from abroad. This memoir consists of two parts, of which the first deals with the foundations of the theory of the struggle for existence, and begins with the introduction of the important concept of quantity of life, besides that of population. The fundamental equations are then established for the case where the individuals of a biological association mutually devour each other, the reasoning being based on the principle of encounters and on the fundamental hypothesis of the existence of equivalents of the individuals (...) constituting the different species which form the association.Having now obtained the equations which determine the rates of change of the numbers of individuals and of the quantities of life of the species, the memoir proceeds to find the equations relating to the stationary state, by establishing theorems which are afterwards applied for the purpose of obtaining the three general laws of the fluctuations. This investigation of the equilibrium state is then followed by the determination of the integrals of the fluctuation equations, and the deduction from these of their most important consequences.The second part of the memoir contains the enumeration and demonstration of the general laws of the struggle for existence, which flow from the discussion of the principles and the integrals obtained in the first part. In this way there is established a new sort of dynamics, demographic dynamics, which, though substantially different from the dynamics of material systems, is developed from an analogous point of view.The second part begins with the principle of the conservation of demographic energy, according to which there are two sorts of energy, one actual and one potential, which transform mutually the one into the other. This principle is the analogue of the principle of conservation of mechanical energy. It is followed by the enunciation of the three laws relating to the biological fluctuations, the experimental verification of which has been investigated by several naturalists. The success which has attended their efforts is well known.Everybody knows the importance ofHamilton's principle in mechanics and in all the domains of physical science. An analogous variation principle can be found in biology, and from it one can deduce the fluctuation equations in the canonical Hamiltonian form and also in the form of a Jacobian partial differential equation. 2Public space is an old habit. The words public space are deceptive; when I hear the words, when I say the words, I’m forced to have an image of a physical place I can point to and be in. I should be thinking only of a condition; but, instead, I imagine an architectural type, and I think of a piazza, or a town square, or a city commons. Public space, I assume, without thinking about it, is a place where the (...) public gathers. The public gathers in two kinds of spaces. The first is a space that is public, a place where the public gathers because it has a right to the place; the second is a space that is made public, a place where the public gathers precisely because it doesn’t have the right—a place made public by force.3In the space that is public, the public whose space this is has agreed to be a public; these are people “in the form of the city,” they are public when they act “in the name of the city.” They “own” the city only in quotes. The establishment of certain space in the city as “public” is a reminder, a warning, that the rest of the city isn’t public. New York doesn’t belong to us, and neither does Paris, and neither does Des Moines. Setting up a public space means setting aside a public space. Public space is a place in the middle of the city but isolated from the city. Public space is the piazza, an open space separated from the closure of alleys and dead ends; public space is the piazza, a space in the light, away from the plots and conspiracies in dark smokey rooms. In this article we explore how female sympathy and solidarity can be forged between transnational subjects and spectators. In particular, we place cinematic depictions of minority female suffering in the contexts of current feminist and postcolonial praxes. The aim is to demonstrate the ways in which world cinema can produce a transnational feminist solidarity through forms and narratives that reflect the experiences of women as gendered postcolonial subjects. Amongst the female and feminist theorists drawn upon, central to our understanding of (...) a transnational feminist solidarity is Sandra Lee Bartky's ‘mitgefühl’. From this understanding we suggest bonds of sympathetic solidarity between audiences and diegetic female subjects that bridge their ontological separation, without conflating the two, in relation to Rachida and Frontière. In combining film-philosophy, cinematic affect and feminist theory we formulate a radically new way of understanding and envisioning the construction of female suffering onscreen: as a means of producing transnational forms of spectator solidarity. This paper analyzes the reasons behind what it calls the erosion of democracy under George W. Bush's presidency since September 11, 2001, and claims that they are twofold: first, the erosion in question can be attributed to a crisis of the state and the belief that security is its only genuine function. In other words, the erosion of democracy is an erosion of the very idea of the public sphere beyond security and war. Secondly, the erosion of the ethical sphere (...) goes hand in hand with an extraordinary resurgence of what, still following Hegel, I call "morality," and which privileges the subjective over the objective, or moral feeling over institutions and the law. The main aim of this work was initially a modest one, 'to collect information as to the main facts of Hutcheson's life in Dublin prior to his appointment as Professor at Glasgow'. As the materials grew, however, and Scott's interest in Hutcheson deepened, the planned article expanded into a book that has since become the standard biography. The emphasis throughout is on the development of Hurcheson's thought in the context of an ongoing debate with his contemporaries.
